1.  Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "Customer," or "User") and South Shore Glass and Mirror, a California company doing business as South Shore Glass & Door ("Company," "we," "us," or "our"). These Terms govern your use of our website, your requests for services, and any resulting service agreements or purchase orders.

Use of this website or engagement with our services for any purpose constitutes your acceptance of these Terms in their entirety. Acceptance may also be manifested by signing a written proposal or contract, submitting a deposit, scheduling services, or otherwise directing us to proceed with any scope of work.

These Terms apply to all visitors, customers, and others who access or use our website or services, whether residential, commercial, or trade/contractor clients.

•       Commercial glazing consultation and project quoting

Note: Product availability and manufacturer lines are subject to change. All specifications, colors, and hardware options should be confirmed in writing at time of order. We reserve the right to substitute comparable products if a specified item becomes unavailable, subject to prior notice and your approval.

 

4.  Estimates, Quotes & Pricing

All estimates and quotes provided by South Shore Glass & Door — whether verbal, written, emailed, or presented on our website — are non-binding until memorialized in a signed written agreement or purchase order.

Validity Period

Written quotes are valid for thirty (30) days from the date issued unless otherwise stated in writing. Prices are subject to change after the validity period expires due to fluctuations in material costs, manufacturer pricing changes, fuel surcharges, or other market conditions.

Scope Assumptions

Estimates are based on information provided by the client at the time of quoting. Unforeseen site conditions — including but not limited to out-of-plumb or out-of-square openings, non-standard framing, rotted substrate, pre-existing damage, inaccessible areas, or code-compliance issues discovered during installation — may require additional work and associated cost. Any such conditions will be documented and presented to you as a written change order prior to proceeding.

Measurement & Field Verification

Final pricing for custom-fabricated glass products (shower enclosures, custom mirrors, specialty glass panels, etc.) is based on field measurements taken by our technicians. Quotes based on customer-supplied dimensions are estimates only and are subject to adjustment after field verification. We are not responsible for pricing errors arising from inaccurate customer-supplied measurements.

Taxes

All prices are exclusive of applicable California state and local sales tax unless specifically noted. Sales tax will be calculated and added to the final invoice at the prevailing rate at time of purchase.

 

5.  Orders, Contracts & Change Orders

For all home improvement work exceeding $1,000 in total contract price, California law (Business and Professions Code §7159) requires a written contract. South Shore Glass & Door complies with all statutory requirements for written home improvement contracts, including required disclosures regarding license number, insurance, and consumer rights.

Contract Formation

A binding agreement is formed when: (a) you sign our written proposal or contract, or (b) you submit a deposit payment, whichever occurs first. At that point, the agreed scope of work, pricing, and timeline are locked in subject to the change order provisions below.

Change Orders

Any modification to the agreed scope of work — including additions, deletions, substitutions, or alterations — must be documented in a written change order signed by both parties before work on the modified scope begins. Change orders are subject to additional pricing based on materials, labor, and scheduling impact. Verbal authorizations for additional work are not binding on the Company. Client acknowledges that change orders may affect scheduled completion dates.

Subcontractors

We may use licensed subcontractors to perform portions of the work. All subcontractors engaged by us are licensed and insured as required by California law. We remain responsible for the quality and completion of all work regardless of subcontractor involvement.

 

6.  Payment Terms

Deposit Requirements

California law limits the deposit for home improvement contracts to the lesser of ten percent (10%) of the total contract price or one thousand dollars ($1,000), whichever is less, unless an exception applies (e.g., materials must be specially ordered in advance). For special-order products including custom glass, custom shower enclosures, and custom door units, a deposit sufficient to cover the cost of materials may be required prior to ordering. The specific deposit amount and schedule will be stated in your written contract.

Progress & Final Payments

Unless otherwise agreed in writing, payment of the remaining balance is due upon completion of installation or delivery of materials, as applicable. For larger projects, progress payments tied to specific milestones may be outlined in the written contract.

Accepted Payment Methods

We accept cash, check, and major credit cards. A convenience fee may apply for credit card transactions above a certain threshold; this will be disclosed at time of purchase. Returned checks are subject to a returned check fee plus any bank charges incurred, in addition to any remedies available under California law.

Late Payments

Amounts not paid when due may be subject to a late charge of 1.5% per month (18% per annum) or the maximum rate permitted by California law, whichever is less. The Company reserves the right to suspend ongoing work and withhold materials if payment is not received as agreed. Client shall be responsible for all reasonable costs of collection, including attorneys' fees, in the event legal action is required.

California Prompt Payment: California's prompt payment statutes (Civil Code §§ 8800–8822 for private works) set requirements for the timing of payments on construction projects. The parties may agree to different payment timing for private projects; any modifications will be set forth in the written contract.

 

7.  Cancellation & Right to Cancel

California law provides consumers with the right to cancel certain home improvement contracts under specified circumstances:

Standard Right to Cancel

For home improvement contracts negotiated at a location other than the seller's fixed place of business, you generally have the right to cancel the contract within three (3) business days of signing, without penalty. As of January 1, 2026, pursuant to AB 1327, cancellation may be submitted via email to our designated email address stated in your written contract, in addition to physical mail or hand delivery.

Senior Citizens (Age 65+)

If you are a senior citizen (age 65 or older), you have five (5) business days to cancel a home improvement contract under California law.

Disaster Repairs

For contracts entered into in connection with a declared state of disaster or emergency, the cancellation period is seven (7) business days.

How to Cancel

To exercise your right to cancel, notify us in writing within the applicable cancellation period. As of January 1, 2026, cancellation notice may be sent by: (1) email to the address provided in your written contract; (2) physical mail to our business address; or (3) hand delivery. Cancellation is effective upon the date the notice is sent. Your written contract will include the required cancellation form and instructions.

Non-Cancellable Special Orders

Custom-fabricated glass, custom-cut mirror, special-order doors and hardware, and other made-to-order items cannot be cancelled, returned, or exchanged once the fabrication or manufacturing order has been placed with the supplier, except as required by law. In the event of cancellation after fabrication has begun, you may be responsible for costs incurred to the date of cancellation, including material costs and any fabrication fees already committed.

 

8.  Lead Times, Scheduling & Delays

Estimated lead times and installation schedules provided by South Shore Glass & Door are good-faith projections only and are not guaranteed unless specifically stated as firm in a written agreement.

Force Majeure

We shall not be liable for delays caused by events beyond our reasonable control, including but not limited to: acts of God, extreme weather (including Tahoe Basin snow events affecting road access), wildfires, evacuation orders, supply chain disruptions, manufacturer backorders, labor disputes, government actions, public health emergencies, or other force majeure events. In such cases, we will make commercially reasonable efforts to complete the work as soon as practicable and will notify you of anticipated delays.

Client-Caused Delays

If installation is delayed due to circumstances under the client's control — including site not being ready, permits not obtained, other trades not completing prerequisite work, or materials not being available due to client decisions — we reserve the right to reschedule at the next available date in our production queue. Additional charges may apply for re-mobilization or rescheduling if the delay results in significant disruption to our scheduling.

 

9.  Installation, Site Access & Site Conditions

Client Responsibilities — Pre-Installation

•       The installation area must be clean, clear of debris, and accessible at the scheduled time.

•       All prerequisite work (tile, waterproofing, framing, rough plumbing, electrical) must be complete and cured before glass installation commences.

•       Any permits required for the scope of work are the responsibility of the property owner unless specifically included in our written proposal.

•       A responsible adult (18 years or older) must be present at the property during installation.

Pre-Existing Conditions

We are not responsible for damage to or defects in pre-existing conditions, including but not limited to: rotted wood, water-damaged framing, existing waterproofing failures, unlevel or out-of-plumb walls or floors, inadequate structural support, or pre-existing mold or moisture issues. Discovery of such conditions will be communicated to you immediately, and a change order may be required before proceeding.

Safety Glazing Compliance

All glass installed in locations required to comply with California Building Code Chapter 24 (Glass and Glazing) and CBC Section 2406 (Safety Glazing) will be safety-glazed tempered or laminated glass as required. Each tempered glass unit will bear a permanent manufacturer's identification mark as required by code. We do not install glass in a manner that violates applicable building codes.

 

10.  Custom & Special Orders

•       Final Dimensions: All custom glass and mirror products are fabricated to final field-measured dimensions. The Company is not responsible for fit issues arising from customer-supplied measurements.

•       Color and Appearance Variation: Natural variation exists in glass tinting, reflectivity, and color appearance (including Solarbronze, Solargray, Graylite II, and similar architectural glass products). VLT (Visible Light Transmittance) values represent nominal industry standards; minor batch-to-batch variation is inherent to manufacturing and is not a product defect.

•       Hardware Finishes: Hardware finish samples are provided for reference. Actual delivered finish may vary slightly from samples due to manufacturing tolerances and lot variation.

•       Non-Returnable: Custom-fabricated and special-order products are not returnable or refundable except in the case of a manufacturing defect confirmed by us in writing.

•       Order Confirmation: You will receive a written order confirmation specifying product description, dimensions, finish, and glass specification. Please review carefully. Discrepancies must be reported within 48 hours of receipt.

 

11.  Product Standards & Code Compliance

California Building Code (CBC)

Glass installations are performed in accordance with California Building Code Chapter 24 (Glass and Glazing), including requirements for safety glazing per CBC Section 2406, and structural glazing requirements under ASTM E1300 for load-bearing applications. Tempered glass bears the permanent manufacturer's identification mark as required by CBC Section 2406.3.

California Title 24 Energy Standards

For window and door installations subject to California Title 24, Part 6 (Building Energy Efficiency Standards), we provide products meeting the applicable U-factor and Solar Heat Gain Coefficient (SHGC) requirements for the applicable climate zone. Dual-pane Low-E glass is standard for new and replacement window/door installations where required.

Seismic Requirements

Glazed curtain walls, storefronts, and glazed partitions shall meet the seismic requirements of ASCE 7, Section 13.5.9, as incorporated into the California Building Code.

 

12.  Warranty & Defects

Workmanship Warranty

South Shore Glass & Door warrants our installation workmanship against defects in labor and installation for a period of one (1) year from the date of completion. This warranty covers improper installation, workmanship errors, and failure of sealants or hardware resulting from our installation, subject to the exclusions below.

Product/Manufacturer Warranty

Products we supply (glass, door units, hardware) are covered by their respective manufacturer warranties, where applicable. We will assist in processing manufacturer warranty claims but are not the warrantor for third-party manufactured products.

Warranty Exclusions

Our workmanship warranty does not cover:

•       Damage caused by misuse, abuse, neglect, or accidents after installation

•       Normal wear and tear, including scratches from improper cleaning

•       Damage caused by harsh chemical cleaners, abrasive pads, or improper care

•       Thermal stress fractures in glass caused by unusual heating, HVAC proximity, or external solar exposure beyond design parameters

•       Settlement, movement, or structural shifts of the building after installation

•       Damage caused by acts of God, including hail, fallen trees, or earthquake

•       Failure caused by modifications made by parties other than South Shore Glass & Door after installation

•       Spontaneous breakage of tempered glass (nickel sulfide inclusion), which is an inherent property of tempered glass and not a workmanship defect

•       Cosmetic damage not reported at the time of installation sign-off

Disclaimer: EXCEPT AS EXPRESSLY SET FORTH HEREIN, SOUTH SHORE GLASS & DOOR MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW.

 

13.  Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SOUTH SHORE GLASS AND MIRROR DBA SOUTH SHORE GLASS & DOOR, ITS OWNERS, EMPLOYEES, AGENTS, OR SUBCONTRACTORS BE LIABLE FOR:

•       Any indirect, incidental, special, consequential, or punitive damages, including loss of use, loss of revenue, loss of profits, or cost of substitute services;

•       Damages arising from delays beyond our reasonable control;

•       Damage to personal property not directly caused by our negligence;

•       Any amount in excess of the total contract price paid by Client for the specific work giving rise to the claim.

Nothing in this section limits our liability for: (a) death or bodily injury caused by our negligence; (b) fraud or willful misconduct; (c) any liability that cannot be excluded or limited under California law, including consumer protection laws.

 

14.  Mechanics Lien Rights & Preliminary Notices

Under California law (California Civil Code §§ 8000-9566, the "Construction Lien Law"), South Shore Glass & Door retains the right to file a mechanics lien against your property if we are not paid for labor, materials, or services furnished in connection with a construction project.

Preliminary Notice

As required by California Civil Code §8200, we may serve a Preliminary Notice on the owner, general contractor, and construction lender (if any) within 20 days of first furnishing labor or materials to the project. This notice is required to preserve our lien rights and does not indicate a payment dispute — it is a standard legal prerequisite.

Mechanics Lien

If payment is not received when due and remains outstanding after demand, we may record a Mechanics Lien against the property in the county recorder's office. A recorded lien may encumber your property title and affect your ability to sell or refinance until the lien is resolved.

Lien Releases

Upon receipt of payment in full, we will provide a Conditional or Unconditional Waiver and Release as appropriate under California Civil Code §§ 8132-8138.

Important: California law does not allow pre-commencement lien waivers. Any contract provision purporting to waive lien rights before work begins is void and unenforceable under Cal. Civ. Code §8122.

 

15.  Dispute Resolution

Good-Faith Negotiation

In the event of any dispute arising out of or related to these Terms, any written contract, or the services provided by South Shore Glass & Door, the parties agree to first attempt to resolve the dispute through good-faith negotiation for a period of thirty (30) days from the date either party provides written notice of the dispute.

Mediation

If good-faith negotiation does not resolve the dispute within the thirty-day period, the parties agree to submit the dispute to non-binding mediation through a mutually agreed-upon mediator or a recognized California mediation service before initiating formal legal proceedings. The cost of mediation shall be shared equally unless otherwise agreed.

CSLB Complaint Process

If you have a complaint regarding our licensing, workmanship, or conduct, you may also file a complaint with the California Contractors State License Board (CSLB) at cslb.ca.gov or by calling 800-321-CSLB (2752).

Venue & Jurisdiction

Any legal proceedings shall be conducted in El Dorado County, California, or the nearest federal or state court of competent jurisdiction. Both parties consent to personal jurisdiction in the State of California.

 

16.  Website Use & Acceptable Use

Access to and use of southshoreglassanddoor.com is provided for informational, commercial, and contact purposes related to our services. By using this website you agree to:

•       Use the website only for lawful purposes and in compliance with these Terms.

•       Not attempt to gain unauthorized access to any portion of the website, server, or database.

These Terms and Conditions and any dispute arising from your use of our website or engagement of our services shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Pursuant to California law, we do not require you to arbitrate disputes arising in California outside of California, nor to apply the substantive law of any other state to disputes arising within California.

 

21.  Modifications to These Terms

South Shore Glass & Door reserves the right to update, modify, or replace these Terms and Conditions at any time. Changes will be effective immediately upon posting to the website with a revised "Last Revised" date at the top of this page.

Your continued use of our website or engagement of our services following the posting of changes constitutes your acceptance of the revised Terms. For active, written service contracts already in effect, changes to these website Terms do not retroactively modify the terms of the signed contract.

 

22.  Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

These Terms, together with any written service agreement or purchase order signed by both parties, constitute the entire agreement between you and South Shore Glass & Door with respect to the subject matter herein, and supersede all prior or contemporaneous communications and proposals, whether oral or written.

Our failure to enforce any right or provision of these Terms shall not be construed as a waiver of such right or provision. No waiver shall be effective unless made in writing and signed by an authorized representative of South Shore Glass & Door.
